Terms of Service & Acceptable Use Policy

Emailmovers Simple Mailer is an email marketing platform operated by Emailmovers Ltd (registered in England and Wales). By creating an account or using this service, you agree to these terms.

You are responsible for ensuring all email campaigns sent through this platform comply with applicable legislation, including but not limited to:

• UK General Data Protection Regulation (UK GDPR)
• Privacy and Electronic Communications Regulations 2003 (PECR)
• CAN-SPAM Act (for emails sent to US recipients)

It is your responsibility to understand and comply with all applicable data protection and electronic marketing laws in the jurisdictions where your recipients are based.

You must only upload and send to recipients who have given valid, informed consent to receive marketing emails from you. You must be able to demonstrate proof of consent if requested. Purchased, rented, scraped, or otherwise non-consensually obtained email lists are strictly prohibited.

You may not use this service to send emails containing or promoting:

• Unsolicited bulk email (spam)
• Phishing, spoofing, or social engineering attacks
• Malware, viruses, or malicious links
• Illegal goods, services, or activities
• Adult or sexually explicit content
• Fraudulent, deceptive, or misleading content
• Content that infringes intellectual property rights
• Hate speech, harassment, or threats of violence

We reserve the right to immediately suspend or terminate any account that we reasonably believe is sending unsolicited bulk email, violating this acceptable use policy, or damaging the deliverability reputation of our sending infrastructure. No refund of unused credits will be issued in the event of termination for policy violations.

You are solely responsible for the content of all emails sent through your account, the accuracy and legality of your recipient data, and maintaining appropriate unsubscribe mechanisms. The inclusion of a working unsubscribe link is mandatory in all marketing emails.

Email credits are consumed when a campaign is sent. Credits are non-refundable once used. Unused credits remain on your account and do not expire. Credit packs are non-refundable after purchase unless required by law.

Custom sending domains purchased through this platform are registered on your behalf. Domain purchases are non-refundable. Domain renewal is your responsibility and will be billed separately.

This service is provided “as is” and “as available” without any warranties of any kind, express or implied. We do not guarantee any specific uptime, delivery rate, or inbox placement. We will make reasonable efforts to maintain service availability but accept no liability for downtime, delays, or delivery failures.

To provide this service, we store and process the following data: your email address, company name, campaign content, and sending analytics. Contact lists you upload are processed through Instiller, our email delivery partner, for the purpose of campaign delivery.

We will not sell, rent, or share your data or your contact lists with third parties except as necessary to deliver the service. You may request deletion of your data by contacting us.

To the fullest extent permitted by law, Emailmovers Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this service. Our total liability shall not exceed the amount you have paid for credits in the 12 months preceding the claim.

We may update these terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated via email.
